Terms of Service

1. Agreement

By creating an account or using SendNow (“the Service”), you agree to these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

SendNow is a secure document sharing and analytics platform designed for financial professionals, sales teams, and businesses. The Service is operated from the European Union.

2. Accounts

You must be at least 18 years old to create an account. You are responsible for maintaining the security of your account credentials. You must immediately notify us at contact@sendnow.live if you suspect unauthorized access to your account.

You are responsible for all activity that occurs under your account, including documents uploaded and shared.

3. The Service

3.1 Document Sharing

SendNow allows you to upload documents and share them via secure links. You control who can access your documents through password protection, email verification, NDA agreements, and link expiration settings.

3.2 Analytics

When someone views a document you share, SendNow collects and provides you with engagement analytics including pages viewed, time spent, device information, and return visit data.

3.3 Microsites

Microsites allow you to bundle multiple documents into a single branded, secure destination with folder organization and granular permissions.

3.4 Availability

We aim for high availability but do not guarantee uninterrupted access. We will make reasonable efforts to notify you of planned maintenance.

4. Plans and Billing

4.1 Free Trial

SendNow offers a 24-hour free trial with up to 2 documents and a 200MB upload limit. No credit card is required. After 24 hours, you must upgrade to a paid plan to continue using the Service.

4.2 Paid Plans

Paid plans are billed monthly or annually as selected at the time of purchase. Prices are listed on our pricing page and may change with 30 days’ notice. Annual plans are billed upfront for the full year.

4.3 Cancellation

You may cancel your subscription at any time by contacting us at contact@sendnow.live. Cancellation takes effect at the end of the current billing period. You retain access to the Service until then. We do not provide refunds for partial billing periods.

4.4 Payment Processing

Payments are processed by Dodo Payments. By subscribing, you agree to Dodo Payments’ terms of service. We never store your credit card information on our servers.

5. Acceptable Use

You agree not to use SendNow to:

• Upload or share illegal content, malware, or viruses
• Share content that infringes on intellectual property rights
• Harass, threaten, or harm others
• Send unsolicited bulk messages or spam via document links
• Attempt to circumvent security measures, rate limits, or access controls
• Reverse-engineer, decompile, or disassemble any part of the Service
• Use the Service for any purpose that violates applicable laws

We reserve the right to suspend or terminate accounts that violate these terms.

6. Your Content

You own your documents. You retain all intellectual property rights to the files you upload to SendNow. We do not claim any ownership over your content.

By uploading documents, you grant SendNow a limited, non-exclusive license to store, process, and deliver your files to the recipients you designate — solely to provide the Service. This license terminates when you delete the document or close your account.

We do not access, read, analyze, or use your documents for AI training, machine learning, advertising, or any purpose other than delivering them to your intended recipients.

7. Data and Privacy

Our handling of personal data is governed by our Privacy Policy. By using the Service, you acknowledge that you have read and understood our Privacy Policy.

Permanent Deletion: When you delete a document from SendNow, it is immediately and permanently removed from all our servers. There are no backup copies, no recovery option, and no archive. Deletion is final.

8. Intellectual Property

The SendNow name, logo, design, and software are the intellectual property of SendNow and are protected by applicable laws. You may not use our trademarks, logos, or branding without our prior written consent.

9. Limitation of Liability

To the maximum extent permitted by law, SendNow shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

Our total liability to you for any claim arising from these terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

These limitations do not apply to liability that cannot be excluded under applicable law, including EU consumer protection regulations.

10. Indemnification

You agree to indemnify and hold harmless SendNow from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these terms.

11. Termination

You may close your account at any time through the dashboard settings or by contacting contact@sendnow.live.

We may suspend or terminate your account if you violate these terms, engage in prohibited activities, or fail to pay for a paid subscription.

Upon termination, all your data (documents, analytics, account information) will be permanently deleted within 30 days.

12. Dispute Resolution

These terms are governed by and construed in accordance with the laws of the European Union. Any disputes arising from these terms or the Service shall be subject to the exclusive jurisdiction of the courts in the EU.

If you are a consumer in the EU, you may also use the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

13. Changes to These Terms

We may update these Terms of Service from time to time. Significant changes will be communicated via email at least 30 days before they take effect. Continued use of the Service after changes become effective constitutes acceptance of the new terms.
